2. What data we process and why

Visiting the website. When you open a page, our hosting provider receives the technical data every browser sends: IP address, date and time, page requested, browser and operating system. They are needed to show the website and to protect it against attacks.

Contact form. If you write to us, we process what you enter: name, email address, type of project and message, plus form of address and phone number if you give them. We use them only to answer your enquiry and, if it becomes a project, to prepare it. The basis is the consent you give by ticking the box in the form (Art. 9 of Uruguayan Law No. 18.331, Art. 6(1)(a) GDPR). You can withdraw it at any time by writing to contacto@tres4cinco.com. To protect the form against automated submissions we use Cloudflare Turnstile, which evaluates technical data from your browser.

Email. If you write to an address at tres4cinco.com, we process your address, your message and the details in it in order to answer you (Art. 6(1)(b) GDPR). Emails arrive in our Gmail mailbox, and our replies are sent through Resend.

WhatsApp. The WhatsApp links open that application. Only then does WhatsApp (Meta) process your data under its own terms.

Usage statistics. Only if you agree in the cookie notice do we use Google Analytics 4 to see which pages are visited and from what kind of device. For this Google sets cookies and receives usage data, including the IP address. You can withdraw your consent at any time under "Cookie settings" at the foot of every page.

3. Pages from other websites

In the section about the region you can view pages from welcomeuruguay.com inside a frame, and in the section about land, the land listing on puntorio.com, the site of the real estate agency Punto Río. These pages load only when you choose a place or open the land listing. At that moment your IP address and technical data from your browser reach the site in question, which processes them under its own responsibility.

4. Who receives the data

• Cloudflare, Inc. (United States): hosting, protection of the website and the form, forwarding of emails to our mailbox.
• Resend (Plus Five Five, Inc., United States): delivery of the form message to our mailbox and sending of our replies by email.
• Google LLC (United States): our email mailbox (Gmail).
• Google Analytics (Google LLC, United States): usage statistics, only with your consent.

We do not sell data and do not pass them to other third parties unless a law obliges us to.

5. Transfers to other countries

We are based in Uruguay, for which the European Commission has issued an adequacy decision (2012/484/EU). The providers named above are in the United States. The transfer relies on their listing under the Data Privacy Framework of the US Department of Commerce, recognised as adequate by the Uruguayan authority URCDP (Resolutions No. 23/021 and 63/023) and by the European Commission (decision of 10 July 2023).

6. Cookies and storage on your device

We do not set any cookies ourselves.

Only if you agree to usage statistics does Google Analytics set cookies. Your browser remembers your choice so that we do not ask on every visit. As long as you do not agree, Google Analytics stays switched off.

7. How long we keep data

Enquiries are kept for 24 months after the last contact. If an enquiry leads to a contract, the statutory retention periods apply. Emails we send through Resend stay stored there for 30 days.

8. Your rights

You can ask for access to your data, and for their correction, updating, inclusion or deletion, and you can object to their processing. Write to contacto@tres4cinco.com. We answer within five business days. If you are not satisfied, you can turn to the Uruguayan data protection authority URCDP (www.gub.uy/unidad-reguladora-control-datos-personales).

If you live in the European Union, you also have the rights in Articles 15 to 21 of the General Data Protection Regulation, including restriction of processing and data portability, and you can complain to the data protection authority of your country.

9. Registration with the URCDP

The registration of our client and enquiry records with the URCDP is in preparation.

10. Security

The website is transmitted encrypted (HTTPS). Only the people who answer enquiries have access to them.

11. Changes and language

We update this text when the website or the law changes. It is published in Spanish, German and English. If the versions differ, the Spanish version prevails.
